Home Office unlawfully detained victim of trafficking for 4 months

The High Court ruled that the Home Office had acted unlawfully in the way in which they detailed and tried to remove a victim of trafficking from the UK in advance of his immigration appeal. They continued detaining him despite agreeing that he should be released.

On 10 November 2017 the High Court handed down a judgment which found that the Home Office had unlawfully detained a victim of trafficking for 4 months, had unlawfully certified his removal and unlawfully refused to give him s.4 accommodation.  The Home Office had considered releasing the Claimant from May 2017 but took until November 2017 to actually provide him with an address.
